General Terms and Conditions (German: AGB)
for the Export of Used Motor Vehicles by Beyond Cars Japan (BCJ Inc.)
Scope and Conclusion of Contract
These General Terms and Conditions govern all contractual relationships between Beyond Cars Japan (BCJ Inc. | 株式会社 ビーシージェイ) and its contractual partners in connection with the purchase and export of vehicles. All contractual relationships shall be governed exclusively by the laws of Japan.
For vehicles from BCJ’s own inventory, a contract is concluded upon written confirmation by BCJ Inc. and receipt of the deposit. From this point onward, the respective vehicle is bindingly allocated to the buyer and will not be sold elsewhere.
For vehicles purchased on behalf of the buyer through a Japanese vehicle auction, the “Additional Terms and Conditions for Auction Vehicles” set out at the end of these GTC shall also apply.
Upon shipment of the fully paid vehicle, the purchase contract shall be deemed fulfilled. The buyer acknowledges that used vehicles may show signs of wear and use consistent with their age and mileage.
For RoRo shipments, the buyer is entered as the official consignee on the Bill of Lading. For container shipments, logistics are handled through the German partner company Beyond Cars Germany (BCG GmbH), while the vehicle remains clearly assigned to the buyer. All official documents are issued accordingly and made available.
Condition and Inspection of Vehicles
All vehicles offered are used motor vehicles. Accordingly, they may show signs of use and wear consistent with their age and previous use. Delivery in as-new condition is excluded.
For vehicles from BCJ’s own inventory, BCJ Inc. carries out a visual inspection in Japan prior to sale. This includes, among other things:
· a test drive of at least 30 minutes with the vehicle at operating temperature
· an inspection for visible defects or irregularities
· a paint thickness measurement
The assessment is carried out to the best of our knowledge and based on our experience. However, it does not constitute a certified inspection or technical expert report.
Defects already known in Japan (e.g. brakes or tyres) are stated in the listing and have already been taken into account in the total price. Please refer to the respective vehicle description in the listing.
Unforeseeable additional costs, such as minor repairs, defects identified during the TÜV inspection, or transport damage, may nevertheless arise and shall be borne by the buyer.
Damage that is not openly visible and is attributable to age, mileage, or previous use shall be considered typical wear and tear and shall not give rise to claims against BCJ.
Claims for rectification or retrospective price adjustments are excluded.
Payments and Payment Terms
Payment of the purchase price is made in several stages depending on the respective vehicle and contractual model. Please observe the payment deadline stated on the invoice.
Only international bank transfers (T/T) are accepted.
To ensure smooth processing, the following information must be provided correctly:
· The respective invoice number in the format “Invoice BCJ-XXXXXX” must be stated as the payment reference.
· “BCJ Inc.” must be stated correctly as the beneficiary.
Incomplete payment information may result in the payment being rejected. All transfer and bank charges shall be borne by the buyer and will not be reimbursed.
In the event of late or incomplete payment, BCJ reserves the right to withdraw from the contract and retain any deposits already paid.
Payments may be made in EUR or JPY. In the event of late receipt of payment, a new invoice will be issued based on the applicable daily exchange rate plus any applicable processing fees.
Insurance During Transport
All vehicles are insured through Tokio Marine & Nichido Fire Insurance Co., Ltd. against total loss during transport. Scratches, dents, scuffs, water damage, or similar damage are excluded. The insurance exclusively covers total loss.
In the event of an insured loss, the purchase price will be reimbursed through the transport insurance. BCJ Inc. shall not be liable for damage occurring during the transport process.
BCJ will actively assist the buyer with filing the insurance claim and communicating with the insurer to ensure prompt and transparent processing.
Transfer of Ownership
Legal ownership of the vehicle shall pass to the buyer only upon full receipt of the agreed purchase price.
Handover or release of the vehicle prior to full payment is excluded.
Delivery Terms
The vehicle will be delivered either by RoRo shipment or container transport to the agreed port or airport.
Unless otherwise agreed, delivery is made under the Incoterm CIF (Cost, Insurance and Freight), meaning that transport and insurance costs up to the destination port are included.
Estimated delivery times are based on the information available at the relevant time and are provided to the best of our knowledge. Events such as weather conditions, military conflicts, strikes, or other unforeseeable circumstances may result in delays.
In such cases, claims for damages or withdrawal from the contract are excluded.
If acceptance of the vehicle is not possible due to incomplete or incorrect information or for other reasons attributable to the buyer, all resulting additional costs – in particular demurrage, storage fees, or renewed shipping costs – shall be borne by the buyer.
BCJ reserves the right to charge any storage or standing costs incurred where delays attributable to the customer result in additional expenses. This also applies to delays caused by the late submission of required documents, such as customs authorisations, or by payments not made within the applicable deadline.
All delivery times are generally non-binding. BCJ provides regular and transparent updates regarding the current shipping status.
No German Statutory Warranty
As a company based in Japan, BCJ is not subject to statutory warranty provisions under German law.
Despite all due care, technical defects may occur when purchasing used vehicles.
Regular maintenance, repairs, or replacement of worn components are part of normal vehicle operation and are not contractual obligations of BCJ.
Goodwill Policy for Hidden Defects in Inventory Vehicles
If significant defects are identified in an inventory vehicle upon handover that were neither previously detectable nor disclosed and are attributable to an error on the part of BCJ, BCJ will endeavour, in close consultation with the buyer, to find a fair and customer-oriented solution.
There is no right of return due to a change of mind or due to wear and tear resulting from age and mileage that is customary when purchasing a used vehicle.
Returns and Cancellation
There is no statutory right of cancellation under German law for cross-border contracts with BCJ.
For inventory vehicles, returns are only possible in exceptional cases where there are significant deviations attributable to BCJ from the description provided in the listing.
In such cases, the vehicle must neither have been registered nor technically modified.
Any refund will be made on a pro-rata basis, less costs already incurred. Processing will be carried out in cooperation with BCG GmbH as BCJ’s German partner company.
As Beyond Cars Japan (BCJ Inc.) is based in Japan and operates exclusively under Japanese law, there is no right of return or refund under German or European consumer law. Withdrawal from the contract, returns, and refunds are generally excluded, including in the case of online or distance sales. This applies in particular, but is not limited to, vehicles individually sourced through auctions or inventory vehicles imported at the customer’s request. By concluding the purchase contract, the buyer expressly accepts these terms and acknowledges the exclusive application of Japanese law.
Data Protection
BCJ processes personal data exclusively for the purpose of performing and administering the contract and in compliance with applicable data protection laws.
Personal data will only be disclosed to third parties where this is strictly necessary for the performance of the contract or required by law.
This applies in particular to the transmission of data to service providers and partner companies, such as shipping companies, freight forwarders, customs agents, as well as our partners in Germany and other European countries.
Only the data necessary for the respective process will be disclosed.
Additional Terms and Conditions for Auction Vehicles
The following conditions apply additionally and exclusively to vehicles purchased by BCJ on behalf of the buyer through a Japanese vehicle auction. In all other respects, the General Terms and Conditions set out above shall apply.
Bidding Instruction and Conclusion of Contract
The buyer instructs BCJ to bid on a specific vehicle up to an agreed maximum bid.
By issuing the bidding instruction, the buyer submits a binding offer to purchase. Upon a successful auction bid, a legally binding purchase contract is concluded.
Vehicle Condition and Vehicle Check
Auction vehicles are purchased on the basis of the information available at the time of the auction.
All information, recommendations, and assessments provided as part of the BCJ Vehicle Check or during direct communication with the customer are given to the best of our knowledge and based on our experience.
They do not constitute a certified inspection, technical expert report, or binding guarantee regarding the condition of the vehicle.
Hidden defects, non-visible damage, technical faults, wear and tear, or damage identified at a later stage may be present.
Auction Grades and Information
Vehicle assessments issued by Japanese auction houses, in particular grades, interior ratings, condition descriptions, and damage diagrams, exclusively represent the assessment of the respective auction house.
BCJ does not warrant the accuracy, completeness, or conformity of these assessments and information with the vehicle’s actual condition.
Any subsequent discrepancies between the information provided by the auction house and the vehicle’s actual condition shall not give rise to any claim against BCJ for rectification or retrospective price adjustment.
Accessories, Keys and Vehicle Documents
For auction vehicles, BCJ does not guarantee the availability of spare keys, service records, repair history, owner’s manuals, tool kits, navigation media, SD cards, remote controls, charging accessories, adapters, or any other accessories.
Complaints and Returns for Auction Vehicles
Auction vehicles are purchased on behalf of the customer based on the information available at the time of the auction.
Following the purchase, BCJ assumes no liability for defects, damage, technical faults, discrepancies, or other problems relating to the vehicle.
Complaints, returns, reversal of the transaction, or reimbursement of costs by BCJ are generally excluded.
